  • By using the Elisha Foods website to purchase our goods and services you agree to accept our Terms and Conditions of use outlined herein when transacting with Elisha Foods - Elisha Jayne Sinclair Pty. Ltd. ABN: 94 609 430 855;

 

  1. Payment Terms

Payment is due prior to delivery. If payment is not received, your order may be cancelled or postponed to the following week.

Our secure payment options are:

  • Credit Card using eWay payments www.eway.com.au or PayPal using paypal.com
  • Gift Vouchers - Purchased Gift Vouchers have 3 year validity from purchase date.  Gift Vouchers are only redeemable on the Elisha Foods website and cannot be exchanged for cash or used as payment towards another Gift Voucher. Gift Vouchers can be used ongoing until the nominated amount is used up. No returns or refunds are valid on gift vouchers. Gift vouchers are non transferable.

 

  1. Pricing & Weights
  • Our minimum order is $50 OR a Small Fruit and Veg box for FREE delivery to Bayside suburbs listed on our website.
  • For orders under the total value of $50 an $8.850 delivery fee applies.
  • Set Produce Boxes are a set price and the weight and quantity of produce varies from time-to-time in-line with market price fluctuations and seasonal produce changes. We update the list weekly and the contents, amounts and weights listed are subject to change. These weights and amounts are given as an indication only and Elisha Foods reserves the rights to make changes in-line with market prices and produce availability.
  • Elisha Foods reserves the right to amend pricing and/or introduce new minimum spend conditions which will be published on our website from time to time.
  • Elisha Foods reserves the right to induce further delivery fees at any stage in the future.

 

  1. Subscription Orders
  • Setting up a Subscription Order is free. No annual membership fees apply.
  • Subscription orders are available based on your preferred delivery frequency. Select from; 1, 2, 3 or 4 week/s apart for deliveries.
  • Upon sign up you acknowledge that your Subscription Order has a recurring payment and you accept responsibility for all recurring charges so these payments can take place.
  • By subscribing you are agreeing to an indefinite period until you notify of cancelation, which can be done in your Account or by notifying our team by email or phone call.
  • You are able to suspend your order and payment for a period or for a single time as required I.e. If you are going to be away. To make a suspension simply login to your Account or contact us by email or phone to notify us of the change.
  • Any Cancellations or Suspensions to your order MUST be made before the cancelation 'Cut Off' date and time of your delivery day which is a minimum of 4 business days before your scheduled delivery date by Wednesday 12noon each week; by phoning, email or updating in your Account. If for some reason you can't get onto a team member please email us in writing to notify us and we will confirm receipt of it.
  • If you miss the cancelation 'cut off' for the given week, outlined above your order will be cancelled commencing from the following week.
  • Likewise if orders are placed after the ordering 'cut off' of Thurs 5pm then your order will automatically register for the proceeding week after.
  • Elisha Foods reserves the right to refuse cancellation and refund of your order after cancelation 'cut off' date and time for that given week (4 business days prior and by 5pm) and your order will be automatically cancelled commencing from the following week.
  • We reserve the right to refuse deliveries to you and to cancel your account where payment/s have been withheld. You agree to compensate Elisha Foods/Elisha Jayne Sinclair Pty. Ltd. in full for all reasonable costs and expenses (including legal costs) in obtaining payments that have not been made in accordance with these terms and conditions.
  • Fruit and vegetable prices are regularly amended and all of our fresh produce that we offer is subject to variations in seasonal availability and supply price. Pricing for a product or products can change over time from when you first set up your subscription order. You accept that the price to be paid for all items in your order will be that stated on the website at the time of the order submission. Always refer to your itemised email confirmations.
  • You must promptly advise us of any payment details that need to be updated, either by phone or by updating your Account.
  • Payment is debited at the time your order is being placed which is at the scheduled order 'Cut Off' time for your delivery day which is 4 business days prior to your scheduled delivery date at 5pm. 
  • If your payment is rejected or declined, your Subscription Order will be cancelled. In this case, please contact us promptly to re-instate your Subscription Order.

 

  1. Order Cancellations (for Single Time Orders)
  •  Cancellations after the order 'Cut Off' time; 4 business days prior to date of scheduled delivery by 5pm will commence from the following week.

 

  1. Delivery, Handling Charges and Taxes
  • For deliveries in the Bayside Melbourne area there is an $8.50 charge for delivery which is purely due to hard cost of delivering our service.
  • Bayside suburbs that receive no charge delivery are as follows; Brighton, Brighton East, Hampton, Hampton East, Sandringham, Black Rock, Highett, Cheltenham and Mentone. 
  • During the COVID-19 period we are strictly servicing the Bayside region listed above. Our website is always being updated and that this may change once the covid-19 restrictions ease. If you would like us to deliver to your area please email us at hello@elishafoods.com.au with your contact details and product preferences and we will reply within 2-3 business days with an outcome.

 

  1. Delivery Conditions
  • To purchase groceries from Elisha Foods, the delivery address you nominate will need to be a suburb Elisha Foods services delivery for. Orders for delivery to addresses in suburbs that are not in the nominated bayside delivery area zone will not be processed. However, please contact us with special requests should you wish to make suggestions about how we can improve our service to better meet your needs and requirements and we will consider this without any guarantees.
  • Delivery times and estimated arrival will vary depending on your order day. For Tuesday deliveries your order will be delivered between 3-7pm. You will be notified of your estimated delivery date and time via email/SMS when you make your first order. Your delivery day and time is subject to change.
  • We do not deliver on Public Holidays and an alternative delivery day will be provided by email or SMS.
  • It is your responsibility to aid ALL needs for Elisha Foods to deliver your order, including but not limited to; building or premise security access, or other considerations in which may impact our ability to access your delivery location.
  • In the event of delivery delays beyond Elisha Foods reasonable control occur. We'll endeavour to provide notice of delay as soon as is reasonably possible. Elisha Foods will not be liable to you or any other person for any such delay.

 

  1. Unattended deliveries
  • Elisha Foods will not be held responsible for any unforeseen damage or theft to your order when left in the designated area as specified by your instruction. We recommend that your delivery is brought inside and stored correctly as soon as possible.

 

  1. Credits, Refunds & Substitutions Policy
  • Elisha Foods aims to delight and bring joy to our customers. If for any reason you are unhappy with a product or our service we will exchange or credit the value of the item. Please contact us within 2 business days from the time of delivery as beyond this we may not refund.
  • Elisha Foods understands and accepts that from time-to-time goods arriving may come damaged, we will replace the goods free of charge or a credit or refund will be applied to your account or card to remedy the issue. If for some reason this does not occur please contact us and we will investigate further to ensure your concern is resolved.
  • To make a return, please inform us either by email or phone with images where possible to support your claim and aid us in resolution of the issue.
  • Our produce and products are subject to availability. We do not always know if a product is available for delivery at the given time of accepting your order. If we are unable to deliver an item ordered we may offer a reasonable substitute.
  • If we are unable to offer a reasonable substitute once already purchased. Elisha Foods will issue a credit to your account or you will be refunded accordingly. Please allow 5 business days for refund processing.
